Release of Liability, Waivers of Claims, Assumption of Risk, Indemnity Agreement, and Jurisdiction Agreement

 

HEALTH NOTIFICATION

Innervate Fitness Kids services are not a substitute for professional medical advice or a medical examination. Prior to your child’s participation in any program, activity or exercise you should seek the advice of your physician or other qualified healthcare professional. You understand that these exercises can be strenuous and should be done in moderation. There is an inherent risk in any exercise that, while providing health benefits, can also cause unknown health issues. Application or reliance on the techniques, advise, ideas and suggestions of any person associated with Innervate Fitness are at the sole discretion and risk of the participant and his/her parent and guardian.

 

WAIVER

I agree, by allowing my child to participate in any program associated with Innervate Fitness Kids, to WAIVE ANY AND ALL CLAIMS that I have or may have in the future against INNERVATE FITNESS PTE LTD and their owners, volunteers, directors, officers, employees, trainers, instructors, agents, officials, independent contractors, servants, representatives, successors and assigns (all of whom are hereinafter referred to as the “RELEASESES”) and TO RELEASES THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer or that my next of kin may suffer as a result of my participation in Athletic Activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, ON THE PART OF THE RELEASEES, AND INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD TO PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF ATHLETIC ACTIVITIES;

 

TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any property damage or personal injury to any third party resulting from my childs participation in Athletic Activities;

 

TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any cost that may be incurred for medical costs, emergency transportation, and litigation resulting from my childs participation in Athletic Activities;

 

That this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;

 

This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of Singapore and no other jurisdiction; and

 

Any litigation involving the parties to this Agreement shall be brought solely within Singapore and shall be within the exclusive jurisdiction of the Courts of Singapore.

 

DISCLAIMER

MYPX PTE LTD and their owners, volunteers, directors, officers, employees, trainers, instructors, agents, officials, independent contractors, servants, representatives, successors and assigns (hereafter referred to as INNERVATE FITNESS) are not responsibly for any death, injury, loss, or damage of any kind suffered by any person whilst using INNERVATE FITNESS facilities, participating in or watching INNERVATE FITNESS activities, caused in any manner whatsoever including, but not limited to, the negligence of INNERVATE FITNESS. I am aware that athletic activities have inherent dangers and risks including but not limited to the potential for serious personal injury or death caused by any INNERVATE FITNESS athletic activity or any condition of the facilities or equipment of INNERVATE FITNESS, some of which include:

 

Transient light-headedness, fainting, abnormal blood pressure, chest discomfort, muscle cramps, muscle soreness, pain, discomfort, fatigue, nausea, heart failure, exercise induced rhabdomyolisis, and so forth;

 

All manner of injury resulting from slipping or falling, either roped or unroped, while jumping, skipping, running, walking, lifting, climbing, and impacting against the floor, walls, equipment, other athletes, or any permanent or temporary fixtures or equipment;

 

Abrasion, entanglement, lacerations, bruising, dislocation, and other injuries resulting from activities on or near stands, racks, weight bars, pullup bars, walls, ropes, cargo-nets, medicine balls, and plyo boxes;

 

That my child will learn and obey the rules and regulations of INNERVATE FITNESS, and that I will allow my child to follow the instructions and directions of INNERVATE FITNESS during athletic activities;

 

That I will inform INNERVATE FITNESS immediately should my child feel any pain, discomfort, fatigue, nausea or any other symptoms that my child may suffer during or immediately after athletic activities.

 

IN CASE OF AN EMERGENCY

I give full permission for any person connected to Innervate FITNESS Kids or Innervate FITNESS to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and/or surgical care for the child and to transport the child to a medical facility deemed necessary for the well-being of the child.

 

PHOTOGRAPHY/VIDEO RELEASE

Participants involved any activities offered by Innervate FITNESS may be photographed or videotaped during training. The undersigned hereby consents to the use of these photographs and/or videos without consent or compensation on the Innervate FITNESS website and Innervate FITNESS social media platforms or in any editorial, promotional or advertising material produced by Innervate FITNESS.

 

INDEMNIFICATION

I recognize that there is a risk involved in the types of activities offered by Innervate FITNESS. I therefore accept financial responsibility for any injury that my child or I may cause either to myself or to others. Should the above mentioned parties or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I will reimburse them for such fees and costs. I agree to indemnify and hold harmless Innervate FITNESS, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by Innervate CrossFit.

 

CONSENT TO PARTICIPATE

I understand that participation in Innervate FITNESS Kids is voluntary, and involves a certain degree of risk when participating in some CrossFit Kids activities. After carefully considering the risks involved, and having full confidence that reasonable precautions will be taken to ensure the safety and well-being of my (son/daughter/ward), I grant permission for my child to become a member of Innervate FITNESS Kids and participate fully in its activities

 

ACCEPTANCE

I, THE UNDERSIGNED, DO HEREBY VERIFY THAT THE ABOVE INFORMATION IS TRUE AND CORRECT. I HAVE READ AND UNDERSTAND THE FOREGOING AND THAT BY SIGNING; IT OBLIGATES ME TO INDEMNIFY THE PARTIES NAMED FOR ANY LIABILITY FOR INJURY OR DEATH OF ANY PERSONAL AND DAMAGE TO PROPERTY CAUSED BY ME. I UNDERSTAND THAT BY SIGNING BELOW, I AM WAIVING VALUABLE LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
